Can NRIs Buy Farmhouse Villas Near Hyderabad?

BY NEXHOUZ ADVISORY BOARD · AUTHORIZED FOR PUBLIC DISTRIBUTION

No. Under RBI's rules, NRIs and PIOs may buy residential and commercial property in India, but not agricultural land, plantation property or a farm house. Around Hyderabad that matters because "farm plots" and "farmhouse villas" are sold heavily to overseas buyers. This guide shows how an NRI with a ₹2 Cr+ budget can tell a permitted purchase from a prohibited one, and what to do instead.

What RBI's rules actually say

RBI's master circular on acquisition and transfer of immovable property in India says an NRI or PIO may acquire immovable property other than agricultural land, plantation property or a farm house. The circular is dated 1 July 2014, so present it as RBI's rules rather than something new, and ask your bank whether anything has changed for your case.

The same circular says an NRI may transfer such property to a resident of India, or to an Indian citizen or PIO resident outside India. In plain terms, you can sell a permitted property to a resident Indian, but the starting point is buying the right category of property.

Why this matters near Hyderabad

Marketing around the city's outer corridors often uses words such as "farm plots", "farmhouse villas", "managed farmland" and "weekend estates". Some are described as plots in a gated layout with a clubhouse, which sounds like a residential project. The label in a brochure does not decide the legal category. What decides it is how the land is classified in the records and what approvals the project actually holds.

The risk is practical as well as legal. If you pay for a property that falls in a category NRIs cannot hold, you may find it difficult to register, finance, sell later or take sale proceeds out of the country. Resolve the category question before the token amount, not after.

Questions to put to the seller in writing

  • How is the land classified in the revenue records: agricultural, or converted for residential use?
  • Is the project registered on the TS-RERA portal, and what is the registration number?
  • What is being sold: a plot, a villa, or a share in a farmland scheme?
  • Can the builder's lawyer confirm in writing that an NRI buyer is eligible to hold this property?
  • What approvals cover the layout, and where can I view the documents?

If the seller will not answer a classification question in writing, treat that as your answer.

A quick comparison

Check the project, not the pitch

Project and agent registration can be checked on the TS-RERA portal. Search the project name and the registration number given to you, and compare the promoter name and location with your sale documents. Property registration itself is handled by the Telangana Registration and Stamps Department. Confirm the stamp duty and fees for your specific purchase with the department or your lawyer instead of relying on a figure quoted in a sales presentation.

If you want space and privacy anyway

Many NRIs who ask about farmhouses really want a large home, greenery and privacy. Gated villa communities and low-density premium projects in areas such as Tellapur, Kollur, Gandipet and Narsingi can offer that while sitting in the residential category. Always verify each project's land use and approvals individually, because location alone tells you nothing about classification.

Paying and signing from abroad

  • Payment: funds must come through normal banking channels, either remitted from abroad or debited to your NRE, FCNR(B) or NRO account. Traveller's cheques and foreign currency notes are not allowed.
  • Power of attorney: India is a party to the Hague Apostille Convention, so a document apostilled in a member country needs no further attestation or legalisation for use in India. A power of attorney can also be signed before the consular officer at an Indian mission with two witnesses. Rules differ by mission, so check your own mission's page.
  • Confirm the format: the person receiving the power of attorney accepts it before the competent authority in India. Confirm the format with the Sub-Registrar's office or a lawyer before signing.

Before you pay anything: a checklist

  1. Ask for the land classification in writing.
  2. Verify the TS-RERA registration yourself.
  3. Get a lawyer's opinion on NRI eligibility for this specific property.
  4. Check the payment route with your bank.
  5. Do not sign a power of attorney until the format is confirmed.
  6. Walk the site on video, with the documents on screen.
